Setting up Wireless Access Points: You and your AUP

So, you have a wireless Access Point (AP) and you want to get it going in your house, eh? Well hold on there chum, it's a bit more complex than you might imagine. And I'm not talking about the technological aspects like Reverse Polarity TNC connectors or WEP Crypto strength, I'm talking about your Internet Service Provider (ISP) and their Acceptable Use Policy (AUP). It might surprise you to learn that in the eyes of some ISP's the simple addition of a AP to your Internet connection places you in direct violation of the agreement you signed (but probably didn't read, did you?) when you had Internet access installed at your house. So what can you do to avoid having your internet service abruptly and permanently cancelled? Pretty easy really, READ the AUP and then abide by it.

If you use an ISP that does not allow you to share your access, then do not allow anyone but the members of your family to access your AP. There are some simple steps to accomplish this:

Of course, if you would prefer to share your Internet access with your neighbors and/or provide access to your friends when they are near your AP (if you didn't you probably wouldn't be here, right? :)), the best procedure is to purchase your Internet access from a provider whose AUP specifically allows you to share your access. So how do you tell which ISPs in Austin allow this use and which ones don't (i.e. suck)? We wondered the same thing; so we created the lists below:

Big Giant Disclaimer: The members of the Austin Wireless Group and VernGraner (the author of these sections) want to strongly and loudly proclaim I (we) are not lawyers! Only you can read and interpret your AUP and determine if an action is legal or not. We do not endorese the breaking of any law nor do we endorse the violation of any contract you may have with your internet provider. The purpose of this document is to provide some insight into what your possible obligations to your ISP may be and how your actions may affect them.

The following is a list of Austin ISP's and what restrictions they have on use of their service. If you intend to set up a Wireless Access point to share Internet connectivity with your neighbors, please make sure you check the ISP's acceptable use policy to see if this use is allowed. In most caes, unless you purchase a "business" class account, sharing your connection is specifically prohibited. The list below is compiled by our users and represents the results of online research.

When in doubt, get it in writing! Do not rely on the word of a sales rep! Make sure they point you to an AUP segment that reflects their interpretation or you may end up having your service pulled!

* This might have changed. RoadRunner now offers wireless APs for an additional $15/month. I assume they will come set up with sharing-unfriendly settings. I believe this also applies only to the residential service.

ISP's the AWG recommends

After reviewing the various AUP's from different ISPs, it becomes quite clear that some are friendly to wireless usage, some indifferent, and some very opposed. In order to promote activities that reflect the wireless group's agenda, we encourage any of you who want to put up an antenna and share the Internet to use one of the following ISPs:

Onramp Note: While its wonderful that Onramp allows NAT and has a liberal AUP, you are getting far less downstream speed and paying more than three times the cost of basic SWBell DSL. That is one very expensive AUP --DavidWhitmarsh

We also strongly urge you to avoid the following ISP's until they change their AUP's to allow wireless sharing:

(a) The ISP Service as offered and provided under this Agreement is a residential service offered for personal, non-commercial use only. Subscriber will not resell or redistribute (whether for a fee or otherwise) the ISP Service, or any portion thereof (1), or otherwise charge others to use the ISP Service, or any portion thereof. (2) Subscriber agrees not to use the ISP Service for operation as an internet service provider, for the hosting of websites (other than as expressly permitted as part of the ISP Service) or for any enterprise purpose whether or not the enterprise is directed toward making a profit."


Southwestern Bell's [WWW]AUP, Relevant Passage Section 8, paragraph E:

"8. USE LIMITATIONS

E. The Service has been designed to be used at the residence or business at which it was installed. You may not allow other residences or businesses to connect to your Service (1) or re-sell your Service in any manner (2). Such action may be subject to immediate termination and you will be charged termination fees, if applicable."
